Terms & Conditions

We have terms and conditions (“T&Cs”) for a few different reasons: 

  • They contain the rules which apply to your use of the Site, including material you might upload to the blog and in reviews
  • They set out all the rules which apply to your purchase of a Product
  • They contain information which we need to tell you, for example your rights under the Consumer Protection Act 1999 USA.

If you use the Site, purchase a Product or upload any material onto the Site, you are confirming that you agree to the T&Cs. They are legally binding on us both. Kindly read through them and please feel free to print or save a copy. Please contact us if you have any queries.

 The T&Cs go hand in hand with some other documents which contain other important information:

  • Our Privacy Policy, where we tell you what information we collect about you and how we use and disclose it (“Privacy Policy”).
  • Our Shipping Policy, where we tell you about Shipping options for a Product and any restrictions on where we can Ship or extra charges (“Shipping Policy”); and
  • Our Return Policy, where we tell you how to return a Product in certain circumstances including because you have changed your mind under the Consumer Protection (Fair Trading) Act.
When you purchase a Product from us, it creates a contractual agreement between you and our company. This section explains how that process works. By placing an order for a Product through our Site, you are making an offer to purchase that Product from us. Once we receive your order, we will send you an order confirmation email outlining the details of each Product you have requested, along with an estimated delivery date. This confirmation email serves as our acceptance of your offer, forming a binding contract for the sale of the Product(s) listed in your order. After your order has been dispatched, we will notify you via email.
All Product prices are displayed on our Site and are subject to change at our discretion. Unless otherwise stated, prices include/exclude shipping charges, which will be added to your total at checkout in accordance with our Shipping Policy. From time to time, our Products may be offered at promotional prices determined solely by our company. The price you pay will be the amount shown at the time of purchase. If prices change after your order is completed, such adjustments will not apply retroactively. We accept the following payment methods: Credit Card (Visa, Mastercard, AMEX), FPX Online Banking, By placing an order, you confirm that all payment details provided are accurate and valid, and that full payment will be made when your order is accepted and processed.

Delivery dates are estimated and are not guaranteed. Subject to stock availability, we aim to dispatch earliest possible, so the order is delivered to you within our promised timeline.

We will always try to fulfil orders, but our only responsibility to you where a Product is no longer available, or if we are unable to supply a particular Product for whatever reason, is to make sure we do not charge you for the Product.

If you are not completely satisfied with your purchase, you may return the item(s) to us in their original condition within 30 days of receipt. Please refer to our Return Policy for full details.

If you decide to change your mind, you must return the Product to us. As required under the Consumer Protection (Fair Trading) Act, you are responsible for taking reasonable care of the Product until it is returned. This does not prevent you from trying on or inspecting the Product to ensure it is right for you; however, we ask that you handle it with the same care you would in one of our stores—keeping tags attached and packaging intact wherever possible.

When using our recommended delivery service (outlined in our Return Policy), you will not be charged for the cost of returning the Product if you change your mind.
Products must be returned in their original packaging with tags intact. We reserve the right to reject returns if the Product has been used, damaged, stained, or is otherwise in a non-sellable condition.

Refunds will be processed within 14 days of receiving the returned Product and will be issued via the original payment method used for purchase. 

If you wish to exchange a product, kindly return the product and make a fresh order.
Please ensure that all Products are used and cared for in accordance with the care instructions provided. It is your responsibility to take reasonable care of any Product purchased from us. We will not be liable for any fault, damage, or issue arising as a result of improper use, handling, or care that is inconsistent with the Product’s instructions.
If you believe the Product, you received is faulty, please contact our customer service team at contact@rafinzaurlux.com. Our team will guide you on the next steps. Kindly include detailed information and, where possible, photographs of the fault to help us resolve the matter promptly.
If you have received a Product different from what you ordered, please email us at contact@rafinzaurlux.com. Our team will advise you on how to proceed with the return. Please provide your order number and details of the incorrect item.
If your packing note shows an item that is missing from your delivery, please contact our customer service team at support@rafinzaurlux.com as soon as possible so we can investigate and resolve the issue.

We take great care in preparing the content and materials displayed on our Site. However, all materials are provided without warranties, conditions, or guarantees of accuracy or suitability for a particular purpose. If you notice any issues, please inform us.

At times, we may need to suspend access to our Site for maintenance or emergency updates. We are not liable for any unavailability, errors, omissions, or technical issues you may experience while using our Site, or for the content of any linked websites.

If we breach these Terms & Conditions, our liability to you will be limited to losses that are a foreseeable consequence of our breach at the time your order was placed or at the time you used our Site.

Our total liability in relation to any order will not exceed the total amount paid by you for the Product(s) concerned.

As our Products are intended for personal use only, we are not liable for any business-related losses, including (but not limited to) loss of data, profit, revenue, or business opportunities.

Intellectual Property
Ownership of Rights
Rafinz Aurlux retains full ownership of all trademarks, trade names, brand names, business names, illustrations, images, logos, registered and unregistered designs, copyrights, and any other intellectual property rights displayed on our Site. These rights are protected by applicable laws and may not be used without our prior written consent.

Rules for User-Generated Content
Some areas of our Site allow you to submit or upload content (“Content”). To ensure a positive experience for all visitors, you agree that your Content will not:

  •  Contain any defamatory, obscene, offensive, hateful, or inflammatory material.
  • Promote sexually explicit material, violence, or discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age.
  • Infringe on any copyright, database right, trademark, or other intellectual property rights belonging to another person.
  • Threaten, abuse, invade another’s privacy, or cause unnecessary distress, annoyance, or harassment.
  • Misrepresent your identity or affiliation with any person or give the impression that your Content is endorsed by us if it is not.
  • Contain or transmit unsolicited or unauthorized advertising, promotional material, or spam.

Ownership of Submitted Content
By submitting Content to our Site, you grant Rafinz Aurlux a perpetual, royalty-free, non-exclusive, irrevocable license to use, reproduce, modify, translate, distribute, display, and sublicense the Content, in whole or in part, in any form and through any medium. This includes the right to use such Content for marketing purposes, including on our own materials and social media channels.

You agree to hold us harmless and compensate us for any losses, reasonable costs, and expenses we incur, as well as any damages ordered by a court or amounts, we pay under an agreed settlement, arising from:

  • Any claim by a third party that your content is defamatory, offensive, abusive, obscene, pornographic, unlawful, or violates any applicable law, regulation, or recognized code of conduct.
  • Any claim by a third party that your content infringes their copyright, trademark, or other intellectual property rights.
  • Any claim by a third party that your content breaches their confidentiality, privacy, or data protection rights. 
We may, at our discretion, decline to publish any content on the site or remove content that has already been published. While we do not carry out ongoing moderation of user submissions, we retain the right to act when necessary. You must not attempt to repost any content that we have declined to publish or have removed from the site.

You must not misuse our site by intentionally introducing viruses, trojans, worms, logic bombs, spyware, adware, keystroke loggers, or any other harmful or malicious code. Attempting to gain unauthorized access to our site, its hosting server, or any server, computer, or database connected to it is strictly prohibited. You must also refrain from carrying out any denial-of-service or distributed denial-of-service attacks.

Any breach of this provision may constitute an offence under the Computer Crimes Act 1997. We will report such violations to the appropriate law enforcement agencies and fully cooperate with them, including disclosing your identity. Upon such a breach, your right to use our site will be terminated immediately.

From time to time, our site may provide access to services operated or supplied by independent third parties. To use these services, you may need to register directly with the relevant provider and communicate with them independently. We do not control the content, availability, or performance of these third-party websites or services. Your use of them is entirely at your own risk, and we are not responsible for any loss, damage, or issues that may result from your engagement with them.
If any provision of these terms and conditions is found to be unlawful, void, or unenforceable, the remaining provisions will remain in effect to the maximum extent allowed by law.

These terms and conditions represent the complete understanding between you and us regarding the supply of products and/or your use of our site. No other terms, conditions, or representations—whether proposed or communicated by you—shall be considered part of our agreement, regardless of whether they are acknowledged or accepted by our staff.

Our right to vary these T&Cs
We may update or change these terms and conditions periodically. The version in effect at the time you place an order for products or use the site will apply to your transaction or activity.

Law and jurisdiction
These terms and conditions are governed by the laws of USA. By using our site or purchasing our products, you agree to submit to the exclusive jurisdiction of the Malaysian courts.

Your Legal Rights
We are legally obligated to provide products that meet the terms of our sales contract with you. Your satisfaction matters to us—if your item is defective, we will either replace it or issue a refund, provided it meets the conditions outlined in our Return Policy. Below is a summary of your key legal rights regarding the product. Nothing in these terms is intended to limit or affect those rights.

If you are not fully satisfied with your purchase, you may return it in accordance with our Return Policy. Should you be unhappy with the response provided or have any concerns regarding your experience with us, you may contact our customer care team via email at support@rafinzaurluxe.com. Upon receiving your complaint, our customer care team will send you an acknowledgement email within 3 working days. If you feel that your concern has not been fully addressed after receiving a final response from our customer care team, please inform them, and your matter will be escalated to our complaints resolution team, who will follow up with you directly.
